What Texas law does — and doesn’t — require in 2026

Texas has no statewide Bitcoin ATM fee cap, no statewide daily kiosk purchase cap, and no statewide 30-day fraud-refund statute. Bills were filed in the 2025 session. None became law. Lawmakers may take it up again in 2027. Until then, Dallas machines run on our operator limits and federal rules, not a Texas kiosk statute. (Bill numbers and dates are under Sources.)

San Antonio passed a June 2026 warning-sign ordinance. That’s a city rule, not a Dallas rule, and not a statewide cap.

The Texas Tribune (July 8, 2026) reported about 1,200 Texans lost $56.8 million to kiosk-aided scams the prior year.

  • Run a written AML program (KYC, monitoring, a compliance officer).

  • File a Currency Transaction Report when cash by or for the same person exceeds $10,000 in a business day, plus SARs when warranted.
  • Keep records. There is a paper trail. “No KYC” / “no paper trail” ads at a U.S. Bitcoin ATM are a red flag.

FinCEN’s Aug. 4, 2025 notice (FIN-2025-NTC1) restated that Bitcoin ATM operators are money transmitters. That’s the federal floor we already operate on — with or without a Texas kiosk statute.

How to use a Bitcoin ATM in Dallas, step by step

  1. Bring the right things. Cash (U.S. bills, no coins — the machine doesn’t make change), a government-issued photo ID, your phone, and a Bitcoin wallet you set up yourself. Never use a QR code a stranger texted you.
  2. Verify your phone number. The kiosk texts a code. Enter it.

  4. Read the on-screen warnings. If someone on the phone is telling you to ignore them, hang up.
  5. Scan your wallet address. Open your receive QR. Confirm the address on screen matches your app.
  6. Insert cash. One bill at a time.
  7. Review the total. Cash in, Bitcoin out, rate, fees, destination. All visible before Confirm.

A quick note on scam awareness

Kiosk fraud is not hypothetical in Texas. Tribune reporting put last year’s statewide losses at $56.8 million. The FBI tracked more than $333 million in Bitcoin ATM fraud nationally in 2025. The pattern is usually a caller posing as the IRS, a sheriff, tech support, or your bank, plus a QR code they sent you.

  • No legitimate agency will ever ask you to pay a fine, bail, tax, or “account freeze” in Bitcoin at a kiosk.
  • Once a transaction confirms on the blockchain, it cannot be reversed. There is no chargeback. Texas has no statewide 30-day kiosk refund statute.
  • If you’re being coached through the screen, or you’ve already sent to a scammer, hang up and call (888) 437-7582 immediately. Then file with local police or IC3.gov. If the send is still in Hold and Release, we may still be able to stop it — that’s the window. After broadcast, we can preserve records and assist investigators.
