What Utah law does — and doesn’t — require in 2026

Utah does have a statewide Bitcoin ATM statute. H.B. 72 (the Virtual Currency Kiosk Regulation Act, Utah Code Title 13, Chapter 82) was signed March 25, 2026, and took effect May 6, 2026. The Division of Consumer Protection administers it — not the Department of Financial Institutions. The Division has said implementing rules were still being drafted after the effective date. The statute itself is already in force.

What the statute actually does at a St. George kiosk:

• A daily purchase cap. For the three calendar days after your first transaction with us, $2,000 per calendar day. After that, $5,000 per calendar day. Those totals apply across every America Bitcoin ATM kiosk in Utah, not per machine. (Utah Code § 13-82-102.)
• No statewide fee cap. A companion 2026 bill, S.B. 173, would have added a 3% fee ceiling. It was not enacted (enacting clause stricken). Utah did not pass a kiosk fee cap.
• No statewide 30-day fraud-refund statute. Receipts have to state our refund policy. That is not Arizona’s 30-day new-customer refund. Once a send confirms on-chain, it cannot be reversed.

Layton and Heber City passed local kiosk bans in 2026. Those are city rules, not a St. George rule, and not a statewide ban.

The FBI’s IC3 (May 2026 PSA) counted 160 Utah complaints and $3.31 million in kiosk-aided losses in 2025, part of more than $388 million nationally.

How to use a Bitcoin ATM in St. George, step by step

Kiosk fraud is not hypothetical in Utah. IC3 counted $3.31 million in statewide kiosk-aided losses in 2025 (160 complaints). Nationally the FBI tracked more than $388 million in Bitcoin ATM fraud that year. The pattern is usually a caller posing as the IRS, a sheriff, tech support, or your bank, plus a QR code they sent you.

• No legitimate agency will ever ask you to pay a fine, bail, tax, or “account freeze” in Bitcoin at a kiosk.
• Once a transaction confirms on the blockchain, it cannot be reversed. There is no chargeback. Utah has no statewide 30-day kiosk refund statute.
• If you’re being coached through the screen, or you’ve already sent to a scammer, hang up and call (888) 437-7582 immediately. Then file with local police or IC3.gov.
