What Arkansas law does — and doesn’t — require in 2026
Arkansas does have a statewide Bitcoin ATM statute. Act 557 of 2025 (House Bill 1467) amended the Uniform Money Services Act and added Ark. Code § 23-55-1008 (Virtual currency kiosk requirements). It was enacted April 14, 2025, and took effect August 5, 2025. The Arkansas Securities Department administers it. The Department’s consumer flyer is here: Virtual Currency Kiosks Flyer (PDF). What the statute actually does at a Little Rock kiosk:
- A daily purchase cap. $2,000 per day for each new customer (registered less than 72 hours). $7,500 per day for each existing customer (registered more than 72 hours). (§ 23-55-1008(g); definitions in § 23-55-102.)
- A fee/commission cap. Total fees and commissions may not exceed the greater of $5 or 18% of the transaction. (§ 23-55-1008(f).)
- A limited new-customer fraud refund. New customers can cancel and receive a full refund for fraudulent transactions that occurred within 72 hours of registration — if, within 14 days of the last such transaction, they contact the operator and file a report with a government or law enforcement agency. (§ 23-55-1008(h).) That is not Arizona’s longer 30-day new-customer refund window; it is Arkansas’s own rule.
- Required ID, disclosures, a receipt, and live phone support during kiosk hours. Government-issued photo ID for each customer; pre-transaction disclosures (amount, fees, irreversibility warning, daily limit); a detailed receipt; and a live telephone line during hours of operation — we staff (888) 437-7582. - Extra call for new customers age 60+. Operators must identify and speak by telephone with an elder adult who is a new customer before that customer’s first transaction. (§ 23-55-1008(i)(7).)

- Run a written AML program (KYC, monitoring, a compliance officer).

- File a Currency Transaction Report when cash by or for the same person exceeds $10,000 in a business day, plus SARs when warranted.
- Keep records. There is a paper trail. “No KYC” / “no paper trail” ads at a U.S. Bitcoin ATM are a red flag.
FinCEN’s Aug. 4, 2025 notice (FIN-2025-NTC1) restated that Bitcoin ATM operators are money transmitters. That’s the federal floor we already operate on — on top of Arkansas’s kiosk statute.

A quick note on scam awareness
Kiosk fraud is the reason Arkansas passed Act 557. The pattern is usually a caller posing as the IRS, a sheriff, tech support, or your bank, plus a QR code they sent you.
- No legitimate agency will ever ask you to pay a fine, bail, tax, or “account freeze” in Bitcoin at a kiosk.
- Once a transaction confirms on the blockchain, it cannot be reversed. There is no chargeback. Arkansas’s refund right for new customers covers fraudulent transactions in the first 72 hours after registration — and only if you contact us and file a law-enforcement or government report within 14 days. After that window, or after you become an existing customer, on-chain sends still cannot be clawed back.
- If you’re being coached through the screen, or you’ve already sent to a scammer, hang up and call (888) 437-7582 immediately. Then file with Little Rock / North Little Rock police or IC3.gov, and consider calling the Arkansas Securities Department at (800) 981-4429.
